In plain words
You own your Carya. Your creations are your property. Carya is merely a place for you to put it. You choose what to publish and sell. Carya provides the service and applies rules to protect people. Mandatory consumer rights still apply.
These Terms form an agreement between PT Solusi Akal Imitasi ("Carya", "we", "us") and the person accepting them ("you"). They govern the Service. Mandatory law prevails over inconsistent wording. Read payments, liability and dispute provisions carefully. Plain-language summaries explain rather than remove or expand the operative rights.
1Definitions
"Account" means your registered account. "Creator" means an Account holder managing content. "Member" means an invited collaborator. "Visitor" means someone interacting with a Page. "Buyer" means a purchaser or payer for a Creator's offer. "Subscriber" means a person subscribing to a Publication.
"Page" means a page made or published through Carya, including related files and posts. "Publication" means a collection of posts or newsletters managed through Issue. "Editor" means the workspace for managing them. "Handle" means a Page's name in Carya's address space. "Custom Domain" means a domain connected to Carya, whether registered independently or bought through Carya under section 7.
"Creator Content" means materials you or someone authorised by you supplies, including writing, images, files, listings and settings. It excludes Carya's own materials and material introduced without your authority because of a failure attributable to Carya. "Agent" means third-party software you authorise to act through the Service.
"Payment Provider" means a third-party payment service. "Carya Checkout" means checkout linked to a Creator's supported payment account. "Paid Plan" includes a paid subscription or separately purchased add-on. "Service" means Carya's website, Editor, publishing, Issue and other features actually made available. Terms for unlaunched features apply only when offered and enabled.
"Content Policy" means the separately notified content rules. Privacy and Cookies policies explain processing and do not turn Terms acceptance into blanket consent. The versions notified under section 33 apply.
2Acceptance, capacity and scope
Account holders affirmatively accept these Terms before using Account features. Carya may record the version, acceptance date and method. Viewing a public Page alone does not create a paid subscription or consent to optional processing.
You must have authority if acting for an organisation. Members remain responsible for their own lawful use. A Buyer's contract for a Creator offer is with the identified Creator, subject to mandatory law and any separately presented transaction terms.
Clearly disclosed and accepted feature-specific terms may modify these Terms only for that feature. Mandatory law prevails. Section 15 governs processor data. The Content Policy governs content and conduct. A privacy notice is not a waiver of rights or a substitute for valid consent.
3Service, availability and feature changes
Carya enables Creators to create, publish and share Pages, offer goods or services, receive messages, manage subscriptions and newsletters, and work with collaborators as offered on the selected plan. Feature availability, limits and charges are disclosed before purchase. Planned features have no promised delivery date unless separately agreed.
Carya may improve and maintain the Service. It will give advance notice of a material reduction in purchased functionality where practicable, preserve accrued rights and provide remedies required by law. No particular availability or support level is promised without written agreement, but Carya remains responsible for applicable standards of care and purchased functionality.
Identified beta features may change or end. Beta status does not remove mandatory duties, responsibility for Carya's own wrongful acts or a promised remedy.
4Ages, minors and guardians
Accounts, Member access and managed subscriptions are for people aged 13 or older. A higher local age threshold or mandatory consent requirement still applies where law requires it.
A person aged 13 to 17 needs a parent's or guardian's consent to use an Account. At sign-up Carya asks for the parent's or guardian's email address and sends them a confirmation link. Until they confirm, the Account can make drafts but cannot publish. Carya may ask for further proportionate confirmation of the guardian's authority, and an entered email address alone is not treated as verified consent in every case.
Selling, connecting payment accounts and buying Paid Plans are available only to people aged 18 or older with legal capacity, and are subject to Payment Provider eligibility. Guardian consent does not unlock them. A minor Buyer may act only through a legally permitted guardian-approved arrangement. Creators must not invite unauthorised payments or unlawful children's-data collection.
Public Pages may be viewed without an Account subject to applicable law. Carya does not knowingly seek data from children under 13. Guardians may request review or deletion at hello@carya.page. Carya may restrict features while age or consent is unresolved.
5Accounts and security
Provide accurate Account information, keep a working email, protect access credentials and use Member invitations rather than sharing sign-in details. Review permissions and promptly report suspected compromise to hello@carya.page.
You are responsible for authorised actions and a failure to take reasonable precautions, not automatically for every action recorded against the Account. This does not shift liability for Carya's breach, defective access controls or unauthorised activity you could not reasonably prevent.
Carya may require proportionate security checks and temporarily restrict access to protect the Account or Service. It will explain and provide a resolution route where lawful and safe.
6Handles and addresses
Handles are subject to availability, reserved names and others' rights. Allocation permits use through Carya, not ownership of Carya's domain or a right to sell or warehouse Handles. Misleading, infringing or abusive Handles may be refused or reclaimed with notice and review where practicable.
Handle changes require a facility Carya offers. Following ordinary Page deletion, a Handle is reserved for its owner for 30 days, then may be released. Safety or legal restrictions may continue longer and cannot be avoided by deletion or re-registration.
7Custom Domains
You retain ownership of independently registered domains and responsibility for rights, renewal and registrar duties. Connection and secure delivery are offered only on qualifying plans.
Delivery may stop when a domain expires, becomes disconnected, infringes rights or loses plan eligibility. Update domain settings after disconnection. Carya will give reasonable notice of a plan-related loss of functionality where practicable.
Domains bought through Carya. Where offered, a Creator on a Paid Plan may buy a domain name through the Service. Carya sells the registration and arranges it with Name.com, Inc., the sponsoring registrar, under Name.com's registration agreement, which applies to you as the domain's registrant. Carya is not a domain name registrar and is not accredited by ICANN. ICANN's Registrants' Benefits and Responsibilities and its information for registrants apply.
The domain is registered in your name and with your email address: you are its registrant and owner, not Carya. Keep your registrant details accurate and up to date. If you fill in the organisation field, that organisation is the domain's legal holder. The registrar emails you to confirm your email address; if you do not confirm it within 15 days, the domain stops working until you do. WHOIS privacy is on by default. Disputes over a domain are subject to the Uniform Domain-Name Dispute-Resolution Policy (UDRP).
The price, including any premium renewal price and applicable tax, is shown before you pay. A registration is for one year. Carya renews a domain only while you have a Paid Plan and only after you pay for the renewal; nothing renews automatically. Carya emails you a renewal link before the domain expires. If you do not renew, the domain expires, may remain renewable for a period set by the registry, with any restore fee the registry sets, and may then be released to others.
Domain fees are not refundable once the domain is registered or renewed, including if you change your mind or cancel your Paid Plan, subject to mandatory consumer rights. If registration fails, Carya refunds you in full automatically. Carya may cancel a registration and refund it within the registry's grace period only for fraud or Carya's own mistake. Where a consumer right to withdraw applies, you are asked at checkout to agree that registration starts immediately and that the right ends once the domain is registered.
You may transfer the domain to another registrar at any time from the Editor, on any plan and after your Paid Plan ends, once the 60-day period after registration in which registrars do not allow transfers has passed. Carya gives you the transfer code and charges no fee to leave. You may point the domain at other nameservers at any time. If your Account ends or your Paid Plan lapses, the domain stays yours until it expires.
Carya may refuse to sell a domain, or stop serving a Page at a domain, used in breach of these Terms. Where the registrar's transfer policy allows, a transfer may be refused on evidence of fraud, a pending dispute or a court order.
8Ownership and content licence
As between you and Carya, you retain your rights in Creator Content. You grant a worldwide, non-exclusive, royalty-free licence to store, reproduce, format, transmit and display it only as reasonably needed to provide, protect and administer the Service according to your choices. Restricted service-provider assistance is permitted for those purposes.
This includes publishing content you make public, sending instructed newsletters, providing authorised Member or Agent access and producing sharing previews when enabled. Restricted content must not be made public through a preview contrary to its settings. The licence does not authorise unrelated private-content promotion or generative AI training.
For materials you supply or authorise, you confirm the rights needed for these uses and the legality of your disclosures and offers. This does not warrant material solely introduced by Carya or uses outside this licence. Collaborator ownership disputes are for those parties; disputed access may be restricted while rights are established.
The licence ends on deletion except for limited backup expiry, required compliance, restricted safety evidence and lawful claims described in the Privacy Policy. Retained evidence is not a continuing publication licence. Independent recipient copies may remain outside Carya's control.
9Publishing and visibility
You control publication through disclosed permissions and functions. Public materials may be copied, indexed or archived by others. Unlisted Pages are accessible to anyone with the address and are not confidential merely because unlisted.
Page passwords limit access but do not make Carya suitable for secrets or regulated information. Do not publish sensitive materials you lack authority to disclose. Removal may not remove independent copies immediately.
Represented visibility restrictions apply to files and previews as well as Pages. A Carya visibility defect is not your instruction to publish restricted content.
Mature Pages. Where offered, a Page showing nudity allowed by the Content Policy must be marked Mature. A Mature Page shows an age notice before its content, is not offered to search engines, shows no picture of its content in link previews and is withheld from Visitors in countries whose law restricts such content, including Indonesia. Carya may mark a Page Mature, or withhold or remove it, where the marking is missing or the content falls outside the Content Policy.
Country restrictions. A Page may be unavailable in some countries because of section 9.4 or section 26.2. Visitors in those countries see that the Page is not available where they are; it remains available elsewhere.
10Generative AI and external reading
Carya does not train generative AI models on Creator Content or personal data or provide them for that purpose. This does not exclude automated safety tools disclosed in the Privacy Policy.
Carya does not provide built-in generative writing/design under these Terms. External Agents process and generate material under their providers' terms and your choices.
Where offered, you may separately request that AI-training services not collect a Page and choose whether answer services may read/cite it. These settings request third-party compliance; they cannot compel it or erase earlier copies.
11Agents and authority
Agents may act only within permissions you or an authorised Member grants. Review permissions and proposed changes before relying on them. Information an Agent receives may be independently processed by its provider.
Authority to edit does not itself authorise publication, deletion or money actions. Any such action must fall within the permissions actually granted and the controls disclosed for the feature. Review available permissions before connecting an Agent.
You remain responsible for actions you authorise within permissions. Carya remains responsible to the extent loss arises from its own breach, defective controls or actions outside authority it was required to enforce. Abusive access and calls exceeding disclosed limits may be restricted.
12Members and teams
Owners and authorised administrators assign roles. Review access regularly. Removed Members lose access; their contributed content may remain with the Page subject to ownership and lawful-processing rights.
Members must comply with these Terms. Owners manage authorised collaborators, but do not assume strict liability for failures attributable to Carya. Team seat charges and changes must be disclosed before purchase or renewal.
13Issue and newsletters
Send only to lawful Subscribers with required permission and evidence. Do not buy, scrape or import unconsented lists. Identify senders accurately and comply with marketing and privacy law.
Issue emails include an unsubscribe facility which may not be removed or obscured. Subscriber data is not property; the authorised controller manages it subject to individual rights. Departing Members may not take/reuse it without both authorisation and a lawful basis.
Carya may delay or restrict sending reasonably suspected to be abusive or unlawful. Carya remains responsible for its own delivery and data-processing duties.
14Forms and visitor information
Collect only what is needed for a disclosed lawful purpose. Supply a suitable notice and required consent controls. Creators are responsible for chosen forwarding destinations and lawful further use.
Ordinary forms must not collect passwords, full card details, government identification numbers or health, biometric and other sensitive data. Such processing requires a separately agreed supported service and appropriate safeguards; generic forms are not represented as suitable for it.
15Privacy and data-processing schedule
Carya is controller for Account administration, Carya billing, security and independent purposes in its Privacy Policy. For Page submissions, Subscriber lists and Creator order data processed only on instructions, the Creator is controller and Carya is processor. Carya is separately controller for its own required legal/accounting records.
Scope. Processing comprises collecting, storing, organising, transmitting and deleting contact details, submitted messages, subscription preferences and transaction metadata to deliver the Service during use and the stated retention period. People concerned are Visitors, Buyers, Subscribers and collaborators. Sensitive data is excluded except incidental lawful safety information or processing under separately agreed safeguards.
Instructions and confidentiality. Carya processes processor data only on documented lawful instructions in these Terms and the Creator's use, including agreed transfer instructions, unless law requires otherwise. It will inform the Creator where lawful and alert them if an instruction appears unlawful. Authorised access must be subject to confidentiality duties.
Security and assistance. Carya maintains risk-appropriate safeguards, assists with rights requests, incidents, impact assessments and regulatory consultation as law requires considering available information, and notifies the Creator of processor-data breaches without undue delay. The Creator's controller duties remain their own.
Subprocessors. Providers disclosed in the Privacy Policy are bound to suitable protection. Carya remains responsible where law requires. Carya maintains a subprocessor list and gives notice of additions or replacements and a reasonable data-protection objection route, with resolution or termination of affected processing if no compliant alternative exists. Any applicable legally required advance-notice period remains in force.
Transfers. Accepting these Terms is not, by itself, consent to international transfers. Carya relies on the transfer basis described in section 11 of the Privacy Policy and puts in place the provider processing and transfer terms the applicable law requires for the actual processing, including for processor data Creators entrust to Carya.
End of processing. Return or delete processor data at the Creator's choice where supported and lawful, subject to required records and scheduled backup expiry. Carya makes compliance information available and permits proportionate legally required audits with security/confidentiality safeguards. An audit may not be refused merely because independent assurance is inconvenient.
16Acceptable use
The Content Policy applies to Pages, posts, files, listings, messages, links and Agents. Do not use Carya for unlawful goods/services, infringement, fraud, phishing, malware, child exploitation, adult sexual content, non-consensual intimate imagery, unlawful personal-data disclosure, threats, harassment, violence/hatred incitement, terrorism or activities requiring a licence you lack. Pornography, sexually explicit material and sexual services are banned, including when presented as art. Non-sexual nudity in an artistic, educational or documentary context is allowed only on a Mature Page under section 9.4 and the Content Policy. Nothing sexual involving a minor is ever allowed.
Do not evade permissions/restrictions, access others' Accounts unlawfully, disrupt security, send spam, knowingly file false reports or use the Service as unrelated file distribution. Permitted automation and non-excludable interoperability rights remain lawful.
Follow applicable sanctions, export restrictions and lawful Provider requirements. Do not conceal identity/location to evade them. This does not declare every foreign sanctions regime applicable to every user.
17Files and limits
Supported formats, file sizes, storage and other limits are disclosed in the Service and plan descriptions. Retain independent copies. Public files may be downloaded and redistributed. Authorised Members manage them within permissions. Deleting a Member does not automatically erase contributions on another owner's Page.
Carya may require use reduction or limit new uploads after proportionate notice for disclosed-limit violations or unreasonable burdens, except urgent safety action. Fair use is not authority for undisclosed charges or retrospective withdrawal of purchased storage without remedy.
18Creator transactions
Creators are responsible for their offers, fulfilment, lawful refunds and complaints. Carya is not represented as merchant of record for Creator transactions merely by supplying checkout. Providers control acceptance, settlement, reserves, reversals and payouts under their actual terms.
Carya Checkout uses a Creator's connected account. Your limited authorisation allows checkout arrangement and status/transaction information within disclosed permissions, not general financial management.
Carya Checkout uses HitPay's Platform API. Creators connect as sub-merchants through their own eligible payment accounts. HitPay automatically allocates the disclosed platform commission at the point of sale and pays Creator proceeds directly to the Creator's bank, subject to its processing fees, settlement rules, reserves and reversals. Carya does not operate a wallet or pool Creator proceeds. The platform commission is not collected by invoicing Creators after the sale. Merchant-of-record status and payment responsibilities remain subject to the applicable contracts and law.
Before payment, disclose seller identity, total price/tax, product characteristics, delivery, refund/cancellation rights and complaint contact. Digital-delivery withdrawal exceptions require any locally mandated express acknowledgements; blanket "no refunds" is insufficient.
Tips. Where offered, a Visitor may pay a Creator a tip through Carya Checkout. A tip is a payment to the Creator, who is responsible for it as for any other sale; sections 18 and 19 apply to it as disclosed when the feature is turned on. A tip is not a charitable donation and is not tax-deductible because it is paid through Carya. Carya offers no escrow, investment or licensed fundraising service, and Creators must not present tips as charitable or public fundraising.
Pay by UPI. Where a Creator in India turns on Pay by UPI, a Buyer pays the Creator's own UPI ID directly from the Buyer's own UPI app. Carya does not process, receive, hold or settle these payments and charges no fee on them: it shows the payment details and an order code, and records the order as the Creator confirms it. GST, invoices and receipts for these sales are the Creator's, as the seller.
Creators bear disputed transaction amounts and all chargeback fees as charged by the Payment Provider under the applicable disclosed arrangement. Creators must respond to disputes and provide evidence through the Provider's process. No fixed IDR chargeback fee is specified by these Terms. Carya remains responsible for its own error and statutory duties; this allocation does not grant unrelated or undisclosed debit authority.
19Transaction fees and tax
Carya charges a 10% platform fee on Carya Checkout sales on the Free plan and a 0% platform fee on Paid Plans. The fee is calculated on the raw sale price of the goods or services, excluding platform fees, taxes and shipping. Payment Provider fees are separate. Independently arranged WhatsApp orders and external checkout links incur no Carya transaction fee. Any applicable currency rounding is disclosed in checkout and the transaction record; it does not change the stated fee base.
Disclose rate, calculation, currency and tax before the fee arises. Changes are prospective under section 33. These Terms alone do not permit an undisclosed debit or withholding of Creator proceeds.
When a Creator refunds a Buyer, Carya retains the platform commission charged on the original sale, including the 10% commission on Free-plan sales. This applies to full and partial Creator-issued refunds; the commission is not recalculated merely because the Creator refunds the Buyer. Payment Provider fees and reversals follow the applicable Provider terms. This rule does not remove a refund or remedy required by mandatory law or excuse Carya's own billing error.
Creators pay taxes legally imposed on their sales/income. Carya handles its own service/fee tax, invoicing, reporting and legally required collection/withholding. Lawful withheld amounts require appropriate evidence. No clause transfers Carya's statutory tax duties to Creators. A plan merchant of record has only responsibilities arising under its actual contract and law.
20Plans, billing, renewal and refunds
Before you pay, Carya shows the seller, the plan, the total price including applicable tax, the billing period, the currency, how renewal works and how to cancel. Paid Plans are sold through Polar, which acts as merchant of record and appears on your receipt.
Automatic renewal applies only if clearly disclosed and validly authorised. You may cancel a Paid Plan at any time from Billing in the Editor. Cancellation stops future renewals and takes effect at the end of the billing period you have paid for; the Paid Plan stays active until then. Price increases apply no earlier than a renewal following notice and any legally required acceptance.
There is no proration or partial refund when you cancel a Paid Plan or stop using it; you keep it until the end of the paid period. Moving to a higher plan takes effect at once and is charged for the rest of the period as shown before you confirm; moving to a lower plan takes effect at the end of the period. Any trial, billing interval or promotion is disclosed before you accept it. Statutory cooling-off, cancellation, refund and other mandatory remedies remain, including those in section 20.4.
Contact hello@carya.page for duplicate charges, billing errors, failure to provide purchased service or a refund entitlement. Carya will investigate and supply the refund, repeat performance, reduction or other legally required remedy. Permanent service discontinuation or removal of its material benefit without an acceptable replacement requires an appropriate refund of the unused affected period. A non-refundable label does not override law.
When a Paid Plan ends, its features stay on for seven more days. Then your most recently published Page stays live, your other live Pages go offline and are kept as drafts, and Custom Domains are disconnected; your Handle address keeps working. Carya emails you when the Paid Plan ends and two days before these changes take effect. You can export your content or subscribe again at any time. Add-ons work with qualifying plans as disclosed at purchase.
21Discounts
Carya may offer a 40% discount on Paid Plans to students and to Creators in eligible countries. Eligibility, duration and any verification are shown before purchase. Discounts do not stack. The offer shown and accepted at purchase controls.
Eligibility may be proportionately rechecked. Inapplicable discounts may end prospectively with notice; deliberate misrepresentation may be addressed lawfully. No undisclosed retrospective price increase is authorised.
22Attribution
Plans requiring the "Created with Carya" badge must disclose it before purchase. Do not conceal or misleadingly alter required attribution. The badge may identify the originating Page for attribution measurement but is not endorsement of its offer. Material changes follow section 33.
23Imports and connections
Connect/import only material you may use. Third-party rights, permissions and privacy duties remain applicable. Carya accesses connected services only within disclosed authority.
On disconnection, authorised access stops and retained credentials are revoked/deleted as applicable, subject to justified security records. Imported content may remain until deleted.
24Independent providers
Sign-in, payments, external shops, embeds and Agents have independent terms and processing roles. Carya cannot guarantee continued integration. Identify when a transaction is with another provider.
Independence does not remove Carya's own responsibility for selection, integration, security or representations where law imposes it. Creators must supply notices/consent controls for their embeds and Carya must meet its own duties.
25Intellectual property
Carya/licensors retain rights in the Service, templates and brand. You may use them for lawful service access but may not separately resell them. You may accurately identify use of Carya, not imply sponsorship or ownership of its marks. No universal trademark registration is asserted.
Voluntary feedback may be used to improve the Service without compensation. This does not assign underlying Creator Content or authorise confidential-information disclosure or unrelated personal-data use.
26Reports, restrictions, child safety and copyright
Use carya.page/report or safety@carya.page. Identify content location and reason, with contact details if a reply is wanted. Do not download or forward suspected child-abuse material to report it. Contact local emergency authorities for immediate danger.
Carya may use reports, automated tools, human review or both, without promising universal monitoring. Credible risk may justify temporary content/account restrictions, proportionately and within lawful authority deadlines, including applicable Indonesian electronic-system duties. Where a competent authority lawfully requires content to be restricted in its country, and the content is lawful elsewhere, Carya may restrict access from that country only rather than removing it everywhere, and tells the Creator which country and why where lawful.
Ordinary restrictions carry reasons and a review route where lawful and practical. Draft retention is not guaranteed: dangerous/unlawful content may be removed rather than returned to the Editor. Deletion or a new Handle does not evade restrictions.
Suspected child exploitation may trigger immediate removal from public and user access, suspension, restricted evidence preservation and reporting to competent authorities and, where appropriate and lawfully available, NCMEC. Notice and ordinary appeals may be withheld where disclosure threatens a child, impedes an investigation or violates law. A safe route to raise genuine misidentification remains where lawful; it gives no right to recover suspected illegal evidence.
Necessary child-safety evidence may be retained in restricted access for approximately one year from the applicable preservation trigger, subject to lawful basis, applicable preservation duties and legal holds. Preservation, authorised access, reporting and release or deletion are governed by a restricted evidence procedure. This is not a claim of NCMEC account approval or universal mandatory US reporting.
Copyright complaints identify the work/right, infringing location, authority, contact and good-faith accuracy statement. An affected Creator may give a reasoned counter-response identifying themselves, the material and the claimed mistake/authorisation, with evidence. Necessary claim information may be shared and content restored only where lawful after review. Formal DMCA counter-notice disclosures, designated-agent registration and restoration deadlines apply only if the necessary legal conditions and procedure exist. Repeat infringers may be terminated in appropriate circumstances.
Ask for a review with the option shown alongside a restriction, or write to safety@carya.page. Carya acknowledges ordinary appeals within seven business days and decides them within fourteen business days after sufficient information is received. A person decides every appeal; automated checks may help prepare it. A qualifying automated decision may be challenged through human review as required by applicable law. Statutory urgent deadlines and the lawful child-safety exceptions take priority; automated checks do not remove those duties.
Carya never passes a reporter's name or email address to the reported Page's owner unless the reporter agrees. This does not prevent a disclosure required by a lawful order, or by a formal copyright counter-notice procedure the reporter chooses to use. Do not retaliate against good-faith reports.
27Export, deletion and retained records
Use available export tools or request assistance at hello@carya.page. A single automated file may not contain every item or third-party record; failed/incomplete export does not limit statutory data access.
Deleting your Account takes your owned Pages offline at once and starts a 14-day period in which you can restore it, unless a safety restriction or a legally required shorter deadline prevents it. Final deletion of routine data follows under the Privacy Policy. Deleting a single Page is immediate and cannot be undone; Carya asks you to confirm first, and its Handle is reserved for you under section 6.2. Contributions to another owner's Page may remain lawfully there.
Billing/team ownership may need resolution but cannot indefinitely defeat erasure rights. Carya will assist with renewal cancellation and appropriate ownership arrangements.
Routine order details are retained up to 30 days after Page deletion to settle late updates, then unnecessary buyer details are stripped; final Account deletion also strips routine buyer details. Amount, fee and reference may remain for accounting. Legally required transaction, tax, claim and safety records are separately retained with restricted use. Routine stripping must not destroy mandatory records, including applicable PMSE records and minimum identifying fields required by law.
Backup expiry and security/safety exceptions follow the Privacy Policy, not indefinite routine storage. Independent recipients retain their own lawful records. Keep copies before deletion.
28Suspension and termination
You may stop use and cancel renewals. Carya may restrict/terminate for material breach, legal duties or credible safety/security risk, with reasons and an opportunity to respond or remedy where lawful and safe.
Urgent safety, fraud, security or authority cases may require immediate action. Restrictions should be no broader or longer than reasonably needed. Section 26's ordinary review and safeguards apply.
Discontinuation requires reasonable notice where practicable, lawful data-retrieval opportunity and appropriate unused-service refunds. Accrued payment duties, ownership, lawful record preservation, disputes and non-excludable rights survive as needed, not as an unlimited content licence.
29Qualifications and mandatory rights
Carya does not promise uninterrupted service or suitability for every purpose. Only where lawful, implied commercial warranties not expressly given are excluded. Statutory quality standards, promised functionality, duties of care, privacy obligations and non-excludable remedies remain.
Creator offers and independent providers are not Carya's offers merely because displayed. Carya remains responsible for its own breach and responsibility imposed by law, including defective permissions and its own material misrepresentations.
30Liability
Subject to section 30.3 and only where lawful, indirect/consequential losses not reasonably recoverable under law are excluded. Direct loss is not deemed indirect solely because it concerns data or business activity.
Where a contractual cap is lawful, Carya's aggregate liability arising from these Terms or the Service is limited to the greater of (a) fees you paid Carya for the Service in the twelve months before the event giving rise to liability and (b) USD 100. This is a single aggregate cap, not one per claim.
No exclusion/cap applies to fraud, wilful misconduct, gross negligence, death/personal injury caused by negligence or liability that law does not permit to be limited. Mandatory consumer remedies and non-excludable personal-data rights are unaffected. The cap does not transfer Carya's responsibilities unlawfully under Indonesian consumer law.
31Limited business indemnity
Only to the extent lawful, a business Creator indemnifies Carya for reasonable amounts finally awarded or settled with that Creator's consent in a third-party claim directly caused by the Creator's unlawful supplied content, material breach or infringement within their control. Consumers do not give this indemnity. It excludes claims caused by Carya's own breach, wrongful conduct, defective controls or use outside the content licence.
Carya promptly notifies the claim, mitigates loss and permits reasonable defence participation. No settlement may admit the other's liability or impose non-monetary duties without consent. Late notice reduces recovery to the extent the defence was materially prejudiced.
The aggregate contractual business indemnity is capped at the fees the Creator paid Carya in the twelve months before the event giving rise to the claim. There is no USD 100 minimum for this indemnity. The cap does not apply to the Creator's fraud or misconduct, including wilful misconduct or deliberate infringement. Any mandatory limit imposed by law remains applicable.
32Law and disputes
Indonesian law governs without removing applicable mandatory consumer protections. First seek good-faith resolution at hello@carya.page, without delaying urgent relief, statutory periods or authority complaints.
Subject to mandatory forum rights, disputes are submitted to the competent courts in Yogyakarta, Indonesia. Consumers retain competent local court and consumer dispute-settlement rights provided by law. No consumer arbitration waiver is imposed.
No BANI arbitration obligation is imposed by these Terms. Any separate arbitration agreement requires its own lawful agreement and does not override mandatory forum rights.
33Changes and notices
Carya dates and retains policy versions. Non-material changes may take effect at any time on publication. Carya gives affected Account holders at least thirty days' direct advance notice before material Terms or Content Policy changes take effect. Changes required sooner by binding law or a lawful urgent authority order apply only to the extent required; Carya explains the requirement where lawful. The notice rule does not authorise unlawful unilateral changes.
Changes apply prospectively. Purchased benefits and accrued rights are not reduced during a paid term without valid agreement or a lawful remedy. Continued use is not acceptance where affirmative agreement is required; consumers are not bound by unlawful unilateral variations.
You may reject material changes by ending affected use and cancelling renewal; statutory and promised unused-period remedies remain. Privacy consent is separate where required. Carya records the notified version, effective date and any affirmative acceptance required by law.
34Language
A legally reviewed Bahasa Indonesia translation will be published alongside the English version. For Indonesian users the reviewed Indonesian version prevails on inconsistency, subject to mandatory law. For others an accepted English text may govern where lawful and clearly agreed.
The translation must preserve the meaning of the English provisions and be available wherever Indonesian-language law requires. This commitment is not a representation that an Indonesian translation has already been delivered.
35General
These Terms, Content Policy and accepted feature terms form the service agreement, with privacy notices and processor provisions applying in their stated roles. Non-excludable rights and representations remain. Accessible email/in-service notices satisfy writing requirements only where law permits.
Invalid provisions are severed only where lawful. Non-enforcement is not a general waiver. Assignment must not materially reduce protections; business transfers remain subject to notice, privacy duties and mandatory rights.
Events genuinely outside reasonable control may excuse affected performance only for the lawful period/extent. They do not excuse ordinary security failures, accrued refunds or notice duties still capable of performance. Reduce impact reasonably.
